Welcome to Nextutor. These Terms and Conditions govern your use of our website https://www.nextutor.co.uk and the services we provide through our platform. By accessing or using our website, whether as a Tutor or Student, you agree to be bound by these Terms. Please read them carefully before using the platform, as they outline your rights and responsibilities while using our services. If you do not agree with any part of these Terms, you must stop using the website and any related services immediately. Our platform connects Tutors with Students to provide online and in-person tutoring services. We facilitate lesson bookings and payments, but we are not responsible for the delivery or content of tutoring services. 2.1. Eligibility
To use our platform as a tutor, you must be 18 years old and above and legally capable of entering into a binding contract. To use our platform as a student, if you are under the age of 18, you must be represented by a parent or legal guardian. By registering, you confirm that all the information you provide is accurate and up-to-date.
2.2. Account Security
You are responsible for maintaining the confidentiality of your login information and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account.
2.3. Tutor Registration
Tutors are required to provide accurate and complete information during registration, including relevant qualifications, identity documents, and background checks such as DBS certificates.
3.1. Tutoring Services
We act as an intermediary connecting Tutors and Students. We do not directly employ Tutors or control their services. As such, we are not responsible for the conduct, performance, or quality of tutoring services.
3.2. Booking and Payments
Students and Tutors can schedule lessons through the platform. Tutors set their own hourly rates, and payments are processed via Stripe. Students agree to pay the agreed-upon rate for each lesson.
3.3. Cancellations and Refunds
Students and Tutors may cancel or reschedule lessons within the platform. There is a 24-hour cancellation policy. If the student cancels the lessons within 24 hours before the lesson, they may be charged. Refunds are subject to the individual Tutor’s policy and platform guidelines.
4.1. Platform Availability
Nextutor aims to maintain an operational website and services, including communication tools, booking systems, and virtual classrooms. However, we do not guarantee uninterrupted access and reserve the right to temporarily suspend the platform for maintenance or upgrades.
4.2. Service Modifications
We reserve the right to modify, update, or discontinue any part of the platform, features, or services at any time without prior notice. We will, however, attempt to inform users of significant changes whenever possible.
4.3. Account Termination
Nextutor reserves the right to suspend or terminate a User's account (Tutor or Student) at its discretion, especially in cases of violation of these Terms and Conditions, misuse of the platform, or engagement in fraudulent or inappropriate behavior.
4.4. Content Monitoring
Nextutor may monitor communications between Students and Tutors, as well as content posted on the website, to ensure compliance with these Terms and Conditions, and to prevent misuse or inappropriate behavior. However, we are not responsible for the actions or content provided by users.
4.5. Identity Verification
We will make reasonable efforts to verify the identity of Tutors and perform background checks where required. However, Nextutor does not guarantee the completeness or accuracy of these checks and encourages Students to exercise caution when engaging with Tutors.
4.6. Communication and Notifications
Nextutor will notify both Tutors and Students of bookings, confirmations, and cancellations through the website and email. Users can manage their notification settings to control how they receive updates.
4.7. Payment Processing
We will process payments between Students and Tutors for completed lessons in a timely manner, usually within 8 days, provided no disputes or payment issues arise. Any payment failures will be addressed promptly.
4.8. Dispute Resolution
In the event of a dispute between Tutors and Students, Nextutor may intervene to assist with resolution but is not responsible for the outcome. Both parties are encouraged to handle disputes amicably within the platform.
4.9. Security and Data Protection
Nextutor will take reasonable measures to safeguard personal data and maintain the security of the platform, but cannot guarantee the website will be completely free from viruses, malware, or security threats.
4.10. Complaints Management
We will make efforts to handle complaints promptly in accordance with these Terms and Conditions. Students and Tutors are encouraged to report any issues or grievances to Nextutor for resolution.
4.11. Refund and Cancellation Policy
Nextutor will ensure that refund requests and cancellations are processed promptly according to our refund and cancellation policies. Refunds will be granted only under circumstances outlined in these Terms and Conditions.
4.12. User Information and Privacy
Nextutor will protect the personal information of Tutors and Students as outlined in our Privacy Policy. However, we are not liable for unauthorized access to data caused by factors beyond our control.
5.1. Account Creation and Information Accuracy
Users must provide accurate and up-to-date information when creating their account. Any false or misleading information may result in suspension or termination of their account.
5.2. Maintaining Account Security
Users are responsible for keeping their account login details, including passwords, secure. Any unauthorized activity on their account must be reported to Nextutor immediately. Users should not share their login credentials with others.
5.3. Compliance with Laws and Terms
Users must comply with all applicable laws and regulations, as well as these Terms and Conditions, when using the platform. Any violation may result in account suspension or legal action.
5.4. Respectful Communication
Users are expected to communicate respectfully with others, including Tutors, Students, and platform staff. Offensive, discriminatory, or inappropriate behavior will not be tolerated and may result in removal from the platform.
5.5. Appropriate Use of Platform
The platform should only be used for its intended purpose of connecting Tutors and Students for tutoring services. Users must not engage in activities that could disrupt the platform, violate intellectual property rights, or harm other users.
5.6. Adherence to Booking Policies
Both Tutors and Students are responsible for ensuring that lessons are booked, canceled, or rescheduled in accordance with the platform's policies. Failure to follow these guidelines may result in penalties or fees.
5.7. Payment Obligations
Students are responsible for paying for lessons as agreed upon at the time of booking. Tutors are responsible for ensuring that payment details are accurate to receive their fees. All Users must adhere to Nextutor's payment and cancellation policies.
5.8. Protecting Personal Data
Users must not share or misuse personal information of other Users obtained through the platform. All data shared within the platform must comply with Nextutor's Privacy Policy and relevant data protection laws (e.g., GDPR).
5.9. Reporting Misconduct
Users are encouraged to report any inappropriate or suspicious behavior, policy violations, or technical issues encountered on the platform to Nextutor. This helps ensure a safe and productive environment for everyone.
5.10. Using Nextutor Materials Responsibly
Users must not copy, reproduce, or misuse any content, materials, or intellectual property available on the website without prior permission. All materials should be used for personal and educational purposes only.
5.11. Responsibility for Technical Requirements
Users are responsible for ensuring they have the necessary equipment, software, and internet connectivity to use the platform effectively, including attending or hosting online lessons.
5.12. Dispute Resolution
In the event of a disagreement or issue with another User (Tutor, Student, or Employee), Users are encouraged to resolve the matter amicably. If needed, they may contact Nextutor for assistance, though Users are primarily responsible for addressing their own disputes.
5.13. Prohibition on Taking Lessons Off-Platform
All Users, including both Tutors and Students, are strictly prohibited from arranging or conducting tutoring sessions outside of the Nextutor platform. This includes but is not limited to arranging payments, scheduling lessons, or continuing an existing tutoring relationship outside of the platform. Any attempt by a Tutor or Student to bypass the platform will be considered a violation of these Terms and Conditions. Engaging in this behavior may result in immediate account suspension or termination, loss of access to the platform, and potentially legal action.
6.1. Providing Accurate Information
Students are responsible for providing accurate and truthful information when creating their account and during interactions with Tutors. Any false or misleading information may lead to account suspension or termination.
6.2. Eligibility and Age Restrictions
Students must be at least 18 years old to book a Tutor for themselves. If a Student is under the age of 18, they must be represented by a parent or legal guardian who consents to the tutoring arrangement. The parent or legal guardian is responsible for managing the account and ensuring compliance with these Terms and Conditions. Nextutor is not liable for any disputes between a minor and their parent or guardian regarding the use of the platform or tutoring services.
6.3. Payment Details for Booking Confirmation
To confirm a booking for the first lesson, Students must provide valid payment details. This ensures that the booking is secured and the Tutor’s time is reserved.
6.4. Authorization for Further Bookings
By confirming a booking, Students authorize the Tutor to make further bookings on their behalf and grant Nextutor permission to charge its service fee as applicable.
6.5. Direct Contract with Tutor
Upon confirmation of the first booking, Students enter into a direct contractual relationship with the Tutor. Students are permitted to share contact details with the Tutor if needed to facilitate the tutoring arrangement.
6.6. Location Accuracy and Setting
Students must ensure that the location for in-person lessons is accurately provided. If lessons are to be held at the Student's address, they must ensure that a suitable and appropriate setting is provided for the lesson.
6.7. Checking Tutor’s Credentials
Before booking a lesson, Students are responsible for verifying the Tutor's expertise, qualifications, and suitability for their needs. This includes reviewing any available profiles, reviews, and credentials.
6.8. Booking Accuracy
Students are responsible for checking that any bookings made on their behalf are accurate and reflect their requirements. This includes verifying lesson times, dates, and any specific details related to the tutoring sessions.
6.9. Timely Payment for Lessons
Students are responsible for ensuring timely payment for lessons as agreed upon during booking. Failure to make payments in accordance with the platform's payment policies may result in account suspension and inability to book further lessons.
6.10. Attending Scheduled Lessons
Students must commit to attending lessons that they book. If a lesson needs to be canceled or rescheduled, the Student must follow the platform's cancellation policies. Repeated no-shows or cancellations without proper notice may lead to penalties or account suspension.
6.11. Respectful Behavior
Students are expected to treat Tutors and other users of the platform with respect and professionalism. Any form of abusive, discriminatory, or inappropriate behavior will result in immediate removal from the platform.
6.12. Communicating via the Platform
All communications between Students and Tutors must be conducted through the Nextutor platform. Students should not attempt to arrange tutoring sessions, share contact details, or communicate with Tutors outside the platform, as this violates the Terms and Conditions.
6.13. Maintaining Privacy and Security
Students must not share sensitive personal information with Tutors or other users, and they are responsible for safeguarding their login credentials. Sharing login information or engaging in activities that compromise the security of the platform is strictly prohibited.
6.14. Recording Lessons
Students agree not to record, store, or share any lessons or parts of lessons conducted through the Nextutor platform, whether by audio, video, or other means. Unauthorized recording or distribution of lesson content is strictly prohibited.
6.15. No Agent or Third-Party Representation
Students are prohibited from acting as agents or representatives of other tutoring companies or organizations for the purpose of hiring Tutors through the platform. All interactions must be solely for personal tutoring services.
6.16. No Requests for Assignment Completion
Students must not request Tutors to complete assignments, coursework, or homework on their behalf. The Tutor's role is to provide guidance and support, not to complete academic tasks for Students.
6.17. Equipment for Online Lessons
Students are responsible for ensuring they have the necessary equipment and technology to participate in online lessons, including a functioning device and stable internet connection. No refunds will be issued if Students are unable to access the online classroom due to inadequate preparation or equipment issues.
6.18. Providing Feedback
Students are encouraged to provide honest and constructive feedback about their lessons and Tutors to help improve the platform's services. However, any feedback provided should be fair, respectful, and not defamatory.
6.19. Dispute Resolution
If a dispute arises between a Student and a Tutor, the Student should attempt to resolve the issue amicably through the platform's dispute resolution tools or by contacting Nextutor support. Unresolved disputes may result in intervention from Nextutor.
6.20. Following Tutor Guidelines
Students must adhere to any reasonable requests or guidelines set by the Tutor regarding the structure, content, and conduct of lessons. This includes arriving on time, being prepared, and participating actively during the lessons.
6.21. Use of Platform Materials
Students must use the materials and resources provided through the Nextutor platform strictly for personal and educational purposes. Any unauthorized copying, distribution, or commercial use of content is strictly prohibited.
6.22. Prohibition on Off-Platform Arrangements
Students are not allowed to request or attempt to arrange lessons with Tutors outside of the Nextutor platform. Doing so is a violation of the Terms and Conditions and may result in immediate account suspension or termination.
6.23. Technical Requirements
Students are responsible for ensuring they have the necessary technology, such as a functioning device and stable internet connection, to attend lessons through the platform's online classroom or any other agreed-upon method.
6.24. AI Reports Service
Students may opt-in to receive AI-powered reports generated from their lesson transcripts. By enabling AI Reports in your account settings, you consent to the processing of your lesson transcripts by artificial intelligence systems to generate personalized educational insights, study recommendations, progress tracking, and feedback. AI Reports are provided as an additional service and are not a substitute for direct communication with your Tutor. The accuracy and completeness of AI-generated content cannot be guaranteed, and Students should use AI Reports as supplementary information only. You may disable AI Reports at any time through your account settings, which will stop the generation of new reports but will not delete previously generated reports.
6.25. Data Processing for AI Reports
When AI Reports are enabled, your lesson transcripts and related data may be processed by third-party AI service providers to generate reports. This processing is subject to our Privacy Policy and data protection obligations. By enabling AI Reports, you acknowledge that your lesson content may be analyzed by automated systems, and you consent to this processing for the purpose of generating educational insights and recommendations.
17.1. Service Description
AI Reports is an optional service that uses artificial intelligence to analyze lesson transcripts and generate personalized educational reports. These reports may include study recommendations, progress insights, homework assignments, follow-up questions, and other educational content designed to enhance your learning experience.
17.2. Opt-In Requirement
AI Reports are an opt-in service. Students must explicitly enable this feature in their account settings and acknowledge that they have read and agree to these terms before the service can be activated. You may disable AI Reports at any time through your account settings.
17.3. Data Processing and Privacy
By enabling AI Reports, you consent to the processing of your lesson transcripts and related educational data by AI systems. This processing is necessary to generate personalized reports and insights. All data processing is conducted in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. Your lesson transcripts are processed securely and are not shared with third parties except as necessary to provide the AI Reports service.
17.4. Accuracy and Limitations
AI Reports are generated using automated systems and may contain inaccuracies, errors, or incomplete information. Nextutor does not guarantee the accuracy, completeness, or reliability of AI-generated content. AI Reports should be used as supplementary educational tools and should not replace direct communication with your Tutor or professional educational advice. Students are responsible for verifying any information provided in AI Reports before acting upon it.
17.5. No Guarantee of Results
Nextutor does not guarantee that AI Reports will improve your academic performance, learning outcomes, or educational progress. The effectiveness of AI-generated recommendations may vary based on individual circumstances, learning styles, and other factors beyond our control.
17.6. Intellectual Property
All AI Reports generated through the service are the intellectual property of Nextutor. Students are granted a personal, non-transferable license to use AI Reports for their own educational purposes. You may not reproduce, distribute, or commercially exploit AI Reports without our express written permission.
17.7. Service Availability
AI Reports may not be available for all lessons, subjects, or educational contexts. The availability of AI Reports depends on various factors, including the quality of lesson transcripts, technical capabilities, and service availability. Nextutor reserves the right to suspend, modify, or discontinue the AI Reports service at any time without prior notice.
17.8. Disabling the Service
You may disable AI Reports at any time through your account settings. Disabling the service will prevent the generation of new AI Reports but will not delete previously generated reports. Previously generated reports will remain accessible in your account unless you request their deletion, which may be subject to our data retention policies.
17.9. Third-Party AI Services
AI Reports may be generated using third-party AI service providers. By using the AI Reports service, you acknowledge that your data may be processed by these third-party providers in accordance with their terms of service and privacy policies. Nextutor is not responsible for the actions, policies, or practices of third-party AI service providers.
17.10. Limitation of Liability
To the fullest extent permitted by law, Nextutor shall not be liable for any damages, losses, or harm arising from the use of or reliance on AI Reports, including but not limited to academic performance issues, incorrect recommendations, or data processing errors. This limitation applies regardless of whether the claim is based on contract, tort, negligence, or any other legal theory.
17.11. Changes to AI Reports Service
Nextutor reserves the right to modify, update, or change the AI Reports service, including its features, functionality, and terms, at any time. We will notify users of material changes to the service through email or platform notifications. Continued use of the AI Reports service after such changes constitutes acceptance of the modified terms.
17.12. Compliance with Educational Standards
While AI Reports are designed to support educational goals, they are not intended to replace formal educational assessments, qualifications, or professional educational advice. Students should continue to follow their Tutor's guidance and maintain communication with their educational institutions regarding their academic progress.
7.1. Minimum Age Requirement
Tutors must be at least 18 years old to register and offer services on the platform.
7.2. Self-Employment Status
Tutors must be eligible to work in the UK on a self-employed basis. They are responsible for managing their tax obligations and complying with UK laws related to self-employment.
7.3. Tutoring Students Under 18
Tutors working with Students under the age of 18 must ensure the Student is represented by a parent or legal guardian who provides explicit consent for tutoring sessions. Tutors should communicate directly with the parent/guardian for lesson arrangements.
7.4. Background Checks (DBS)
Tutors must have a valid Disclosure and Barring Service (DBS) background check, especially when working with minors, to ensure the safety of underage Students.
7.5. Providing Accurate Information
Tutors must ensure their profiles accurately reflect their qualifications, experience, and background checks, and regularly update their information.
7.6. Adherence to Terms and Consequences for Violations
Tutors found violating Nextutor's Terms and Conditions will be permanently blocked from the platform. Nextutor reserves the right to cancel any existing bookings at the time of the violation without notice.
7.7. Setting an Appropriate Rate
Tutors are responsible for setting their own hourly rate, which should reflect their qualifications, experience, and market rates. Charging too high may limit their pool of potential clients, while charging too low may undervalue their expertise.
7.8. Offering Discounts
Tutors have the flexibility to offer customizable discounts to Students, with the maximum discount capped at 50% of their standard rate. Tutors also have the option to apply specific discounts when a Student books 3, 5, or 10 lessons in advance.
7.9. Booking Accuracy
Tutors are responsible for ensuring that lesson bookings are made correctly and reflect the agreed time, duration, and location. Any discrepancies should be immediately communicated to the Student.
7.10. Ranking and Performance Metrics
Tutors agree to be ranked on the platform based on various factors, including Student ratings, the number of lessons taught, and responsiveness in messaging. Nextutor reserves the right to adjust Tutor rankings at any time.
7.11. Booking Lessons Only When Instructed
Tutors must only book lessons when explicitly instructed by the Student or their parent/guardian. If a Tutor fails to complete a lesson they booked, they may be held responsible for refunding the Student directly for any payments received.
7.12. Responsibility for No-Show Lessons
If a Student fails to join a lesson, Tutors must attempt to contact them (via phone or messaging). Tutors must provide evidence of their efforts and allow at least 15 minutes for the Student to join. Failure to follow this protocol may require the Tutor to refund the fees received for the lesson.
7.13. Punctuality for In-Person Lessons
Tutors must ensure they have the correct lesson location and arrive on time for in-person lessons. If a Tutor is late, they must inform the Student and provide evidence of this communication. Failure to do so may result in refunds being owed to the Student.
7.14. Verification of Student Information for In-Person Lessons
Tutors must verify the Student's address and ensure it is correct for in-person lessons. If a lesson is conducted at the Student's home, the Tutor must ensure the location is appropriate for learning.
7.15. Preparation for Lessons
Tutors must be fully prepared for lessons, ensuring they have all necessary materials. Lack of preparation may result in negative feedback and affect Tutor rankings.
7.16. Lesson Cancellations and Rescheduling
If a Tutor needs to cancel or reschedule a lesson, they must inform the Student as early as possible, following the platform's cancellation policies.
7.17. Professional Conduct and Boundaries
Tutors must maintain professionalism and appropriate boundaries with Students at all times. Failure to do so may result in account termination.
7.18. Ensuring a Safe Learning Environment
Tutors must provide a safe, distraction-free environment for both in-person and online lessons.
7.19. Communication through the Platform
All communications between Tutors and Students must take place through Nextutor's platform. Off-platform communication is prohibited unless explicitly authorized by Nextutor.
7.20. No Off-Platform Solicitation
Tutors are prohibited from soliciting Students for off-platform tutoring services or directing them to other tutoring businesses. Doing so violates the Terms and Conditions and may result in account termination.
7.21. Prohibition of Recruiting for External Services
Tutors must not use the platform to recruit Students for other tutoring services or businesses outside of Nextutor.
7.22. Respecting Student Privacy
Tutors must respect the privacy and boundaries of Students, refraining from engaging in any personal relationships outside of the tutoring context.
7.23. Equipment for Online Lessons
Tutors are responsible for ensuring they have the necessary equipment (e.g., laptop, stable internet connection) to conduct online lessons. If the Tutor is unable to deliver the lesson due to technical issues on their end, they may be required to refund the Student.
7.24. No Completion of Student Assignments
Tutors must not complete Student assignments, coursework, or exams. Tutors are expected to guide Students but not engage in academic dishonesty.
7.25. Adherence to Refund Policies
Tutors must adhere to Nextutor’s refund policies and provide refunds to Students if they fail to meet their responsibilities, such as failing to complete a booked lesson or arriving late without notice.
7.26. Tutors Must Not Record Lessons Separately
Tutors must not record lessons or store/share them without the explicit permission of both the Student and Nextutor. All recorded lessons must be done through the platform.
7.27. Tutors Agree to Share Recorded Lessons
Tutors agree that recorded online lessons may be shared with the Student, ensuring transparency and accountability.
7.28. Data Privacy and Security
Tutors must respect the privacy of Students and comply with all data protection laws. Any personal information shared with Tutors through the platform must be kept confidential and not shared with third parties.
7.29. Non-Discrimination
Tutors must treat all Students fairly, without discrimination based on race, gender, religion, disability, or any other protected characteristic.
7.30. Reporting Issues
If a Tutor encounters any technical issues, inappropriate behavior from a Student, or any other concerns, they must report this to Nextutor immediately.
7.31. Providing Adequate Notice for Termination of Services
If a Tutor decides to stop offering services through the platform or to an individual Student, they must provide adequate notice to allow for a smooth transition and avoid disrupting the Student’s learning.
7.32. Responding to Student Queries
Tutors should respond promptly and professionally to Student inquiries or messages within a reasonable time frame to maintain effective communication.
7.33. Respect for Intellectual Property
Tutors must not use or share any materials, lesson plans, or resources that infringe upon the intellectual property rights of others. Any materials used in lessons should be either original or appropriately licensed.
7.34. Providing Feedback and Progress Updates
Tutors should provide constructive feedback and progress updates to Students or parents (where applicable). This ensures Students can track their development and improve over time.
8.1 Payment Details Requirement:
Students must provide valid payment details when confirming the booking for the first lesson. Failure to do so may result in the inability to confirm or proceed with the booking.
8.2 Lesson Fee and Payment Authorization:
A Lesson Fee comprises both the Tutor Fee and Nextutor's Service Fee, which Stripe will collect on behalf of Nextutor. All fees include any applicable VAT or other sales taxes. By confirming a booking, the Student authorizes Nextutor to instruct Stripe to charge their debit or credit card once the Tutor marks the lesson as complete. For lessons that are booked with discounts for sessions of 3, 5, or 10 in advance, the total payment for these discounted lessons will be charged to the Student’s debit or credit card at the time of booking confirmation.
8.3 Lesson Fee Display:
The Lesson Fee that a Student needs to pay for a Lesson will be shown on the Website when confirming a Booking. This fee will also be visible on the Student’s lesson dashboard, in reminder emails, and in payment confirmation emails after the Lesson.
8.4 Payment Processing Timeline:
Nextutor aims to process all payments within 7 days of the lesson's completion, provided there is no dispute or complaint. Delays may occur if there are payment issues or disputes.
8.5 Failed Payments:
In cases of failed payments (e.g., declined cards, insufficient funds), Nextutor will notify the Student. The Student must resolve the issue promptly to continue using the platform. Tutors are not required to provide lessons until payments are cleared.
8.6 Refund Policy:
Refunds will be issued in line with Nextutor's refund policy. If a lesson is canceled by the Tutor or Nextutor, or if a Student has valid reasons for dissatisfaction (e.g., the lesson did not take place), a refund may be issued.
8.7 Refund Responsibility for Incomplete Lessons:
If a Tutor books a lesson and fails to complete it without proper communication, they may be held responsible for refunding the Student directly. Nextutor may also intervene to resolve disputes.
8.8 Discounts and Promotions:
Tutors may offer customizable discounts to Students, up to a maximum of 50% off their standard rate. Tutors also have the option to offer discounts when a Student books 3, 5, or 10 lessons in advance. Discounts will be applied at the time of payment processing.
8.9 Booking Fees:
Tutors are prohibited from charging additional booking fees outside of what is processed through Nextutor's platform. All fees must be handled through the platform to ensure transparency and compliance with payment policies.
8.10 Payment for Online Lessons:
Students are responsible for ensuring they have the proper equipment (e.g., laptop, stable internet) to access online lessons. No refunds will be issued if Students are unable to join due to technical issues on their end.
8.11 Currency of Payment:
All payments on the platform are processed in GBP (£). Any currency conversion fees or international transaction fees incurred by the Student or Tutor will not be covered by Nextutor.
8.12 Direct Contract Between Student and Tutor:

If a Tutor fails to deliver a lesson and is found responsible (e.g., no proper communication or effort to contact the Student), they must refund any Tutor fees received for that lesson.
8.14 Cancellation Fees:
Nextutor may apply cancellation fees if Students or Tutors cancel lessons within a specified period before the lesson. These fees will be deducted from the refund amount if applicable.
8.13 Processing Time for Refunds:
Refunds, if applicable, will be processed promptly, but may take up to 14 days to appear in the Student’s account, depending on the payment method used.
8.14 Disputes and Payment Holds:
In the event of a dispute between a Tutor and a Student regarding a lesson or payment, Nextutor reserves the right to place a hold on the funds until the dispute is resolved.
8.15 Handling Payments:
Payments are handled by Stripe (https://stripe.com/gb), a third-party service provider. You understand that Nextutor collaborates with Stripe for payment processing and account management. All account information you provide will be shared with Stripe. By submitting your personal information, you consent to Nextutor automatically sharing this data with Stripe.
9. Cancellation Conditions
9.1 Student Cancellations:
9.1.1 Notice Period:
Students must provide notice of cancellation at least 24 hours before the scheduled lesson to avoid being charged. Cancellations made within 24 hours of the lesson may incur a cancellation fee.
9.1.2 Cancellation Fees:
If a Student cancels a lesson less than 24 hours before the scheduled time, they may be charged a cancellation fee, which could be a percentage of the Lesson Fee or the full amount, depending on the platform’s policy.
9.1.3 Rescheduling:
Students may be allowed to reschedule a lesson within a specified period, subject to Tutor availability and platform policies. Rescheduling does not automatically waive any cancellation fees.
9.2 Tutor Cancellations:
9.2.1 Notice Period:
Tutors must provide notice of cancellation at least 24 hours before the scheduled lesson to avoid penalties. Cancellations made within 24 hours of the lesson may lead to a penalty or fee, which could be deducted from their earnings.
9.2.2 Cancellation Fees:
Tutors who cancel a lesson with less than 24 hours’ notice may be responsible for refunding the Student any fees paid for that lesson. Additionally, Nextutor may impose a penalty or fee on the Tutor.
9.2.3 Rescheduling:
Tutors are encouraged to offer alternative times for rescheduled lessons if they cancel. Rescheduling does not necessarily absolve the Tutor from any cancellation penalties.
9.3 Platform-initiated Cancellations:
9.3.1 Cancellation by Nextutor:
If Nextutor cancels a lesson due to platform issues or other reasons, Students and Tutors will be notified, and refunds will be processed as per the platform’s refund policy.
9.3.2 Emergency Situations:
In cases of emergency or unforeseen circumstances where a lesson cannot take place, Nextutor will review the situation and determine appropriate actions, including potential refunds or rescheduling
9.4 Refunds:
9.4.1 Eligible Refunds:
Refunds will be processed for cancellations made in accordance with the platform’s policies. Eligibility for refunds may depend on the timing of the cancellation and whether the lesson was cancelled by the Student, Tutor, or Nextutor.

Approved refunds will be processed promptly but may take up to 14 days to reflect in the Student’s account, depending on the payment method used.
9.5 Disputes and Resolution:
9.5.1 Dispute Resolution:
In the event of a dispute over cancellations or refunds, Nextutor will review the case and make a determination based on the provided evidence and platform policies.
9.5.2 Appeals:
Students and Tutors have the right to appeal cancellation decisions by contacting Nextutor’s support team. The appeal process will be reviewed in accordance with the platform’s terms and conditions.
9.6 No-Show Policy:
9.6.1 Student No-Shows:
If a Student does not attend the lesson and has not provided prior notice of cancellation, they may be charged the full Lesson Fee, as they have not given sufficient time for cancellation or rescheduling.
9.6.2 Tutor No-Shows:
If a Tutor fails to attend a lesson without providing prior notice or valid reason, they may be responsible for refunding the Student any fees paid for that lesson and may face additional penalties.
9.7. Communication of Cancellations:
9.7.1 Notification
Both Students and Tutors are required to notify Nextutor of any cancellations through the platform. Notifications should include details of the reason for cancellation and any relevant evidence if applicable.
10. Referral Program
10.1 Overview:
Nextutor offers a Referral Program that allows Students to invite their colleagues and friends to join the platform. By referring new Students, existing Students can earn rewards in the form of free lessons, subject to the conditions outlined below.
10.2 How the Referral Program Works:
10.2.1 Referral Process:
A Student (the “Referrer”) can enter the email addresses of friends or colleagues they wish to invite to Nextutor. Upon submission, the invited individuals (the “Referees”) will receive an email with a unique referral link.
10.2.2 Account Creation:
The Referees can click the referral link, browse available Tutors, and create an account on Nextutor.
10.2.3 Completing the First Lesson:
Once the Referee completes their first lesson, the Referrer will receive a free lesson as a reward.
10.3 Eligibility:
10.3.1 Referrer Requirements:
The Referral Program is only available to registered Students on Nextutor. The Referrer must have an active account on Nextutor at the time of referral and when claiming the reward.
10.3.2 Referee Requirements:
The Referee must be a new user who has not previously signed up on the platform.

10.4.1 Free Lesson for Referrers:
A Referrer will receive one free lesson for each successful referral. A referral is considered successful when the Referee completes their first paid lesson with a Tutor.
10.4.2 Reward Limits:
The free lesson awarded to the Referrer will be for one hour, though Nextutor may set a maximum duration limit.
10.5 Restrictions and Abuse Prevention:
10.5.1 No Self-Referrals:
A Referrer cannot refer themselves or create multiple accounts to abuse the referral system.
10.5.2 Spam and Misrepresentation:
The referral link must be shared in good faith; any form of spam, unauthorized advertising, or misrepresentation is strictly prohibited.
10.5.3 Investigation and Withholding of Rewards:
Nextutor reserves the right to investigate and withhold rewards in cases of suspected abuse, fraudulent activity, or violation of these terms.
10.6 Reward Redemption:
10.6.1 Free Lesson Credit:
The free lesson earned through a successful referral will be credited to the Referrer’s account within 48 hours after the Referee completes their first lesson.
10.6.3 Non-Transferable:
The free lesson is non-transferable and cannot be exchanged for cash or any other compensation.

Nextutor reserves the right to modify, suspend, or terminate the Referral Program at any time without prior notice.

12.1 Safeguarding and Child Protection:
Nextutor will comply with the UK’s safeguarding and child protection laws to ensure the safety and well-being of children under 18 using the platform. All Tutors are expected to adhere to these safeguarding policies.
12.2 Disclosure and Barring Service (DBS) Checks:
All Tutors who work with children under the age of 18 are required to have a valid and up-to-date DBS check to ensure they have no criminal convictions that make them unsuitable to work with children. Failure to provide this documentation may result in suspension from the platform.
12.3 Parental/Guardian Consent:
For students under 18, a parent or legal guardian must provide explicit consent for the child to receive tuition services. This includes being the point of contact for arranging lessons, payments, and overseeing the child’s participation.

Tutors are strictly prohibited from discussing or sharing inappropriate content with minors, including offensive language, indecent materials, or any form of harassment or exploitation.
12.8 Tutoring Boundaries:
Tutors must maintain appropriate professional boundaries with students. They are not allowed to engage in personal relationships with students under 18, either online or offline. Breaching this will result in immediate suspension and possible legal action.

Tutors must ensure that any online tutoring sessions with children under 18 are conducted in a safe, secure, and appropriate environment, using only Nextutor's approved platforms for lessons. Recordings of lessons may be used to ensure the safety and integrity of sessions involving minors.

To the extent permitted by law, Nextutor will not be liable for any direct, indirect, incidental, consequential, or special damages that arise from the use of the platform or tutoring services, including but not limited to loss of profits, data, or reputation, even if Nextutor has been advised of the possibility of such damages.

Payments on the platform are processed through Stripe, a third-party payment processor. Nextutor disclaims any liability for issues that arise from Stripe's service, including but not limited to payment processing errors, delays, or security breaches. Nextutor does not take responsibility for the content generated by Users (including but not limited to Tutor profiles, reviews, and messages). Any such content is the responsibility of the User who posted it, and Nextutor disclaims liability for any inaccuracies, misrepresentations, or offensive content.

Nextutor is not liable for any failure to perform its obligations under these terms and conditions due to events outside its reasonable control, including but not limited to acts of God, natural disasters, war, civil unrest, technical failures, or government actions (collectively referred to as Force Majeure).

By enabling AI Reports, you consent to the processing of your lesson transcripts and related educational data by AI systems. This processing is necessary to generate personalized reports and insights. All data processing is conducted in accordance with our Privacy Policy and applicable data protection laws, including the UK GDPR. Your lesson transcripts are processed securely and are not shared with third parties except as necessary to provide the AI Reports service.
17.4. Accuracy and Limitations
AI Reports are generated using automated systems and may contain inaccuracies, errors, or incomplete information. Nextutor does not guarantee the accuracy, completeness, or reliability of AI-generated content. AI Reports should be used as supplementary educational tools and should not replace direct communication with your Tutor or professional educational advice. Students are responsible for verifying any information provided in AI Reports before acting upon it.
17.5. No Guarantee of Results
Nextutor does not guarantee that AI Reports will improve your academic performance, learning outcomes, or educational progress. The effectiveness of AI-generated recommendations may vary based on individual circumstances, learning styles, and other factors beyond our control.
17.6. Intellectual Property
All AI Reports generated through the service are the intellectual property of Nextutor. Students are granted a personal, non-transferable license to use AI Reports for their own educational purposes. You may not reproduce, distribute, or commercially exploit AI Reports without our express written permission.

AI Reports may not be available for all lessons, subjects, or educational contexts. The availability of AI Reports depends on various factors, including the quality of lesson transcripts, technical capabilities, and service availability. You may disable AI Reports at any time through your account settings. Disabling the service will prevent the generation of new AI Reports but will not delete previously generated reports.
